So there are number of 44 00:02:12.039 --> 00:02:14.360 key issues not just hit on them quickly and then 45 00:02:14.400 --> 00:02:17.800 happen to talk about them in more detail. One is 46 00:02:17.840 --> 00:02:21.240 that when people are found permanently incompetent to stand trial, 47 00:02:21.960 --> 00:02:25.080 the court has to dismiss the case. To me, it's 48 00:02:25.120 --> 00:02:29.240 a failure for public safety, for victims and for our communities. 49 00:02:28.759 --> 00:02:32.960 That doesn't trigger an automatic admission to a facility. The other area 57 00:02:55.000 --> 00:02:58.560 that we as a bipartisan group of district attorneys highlighted 58 00:02:58.960 --> 00:03:01.360 and then I remain very concerned about to this day 59 00:03:01.919 --> 00:03:05.719 is the significant backlog at the state hospital. So, as 60 00:03:05.759 --> 00:03:08.639 you know, Dan, there are hundreds of people awaiting in mission, 61 00:03:08.879 --> 00:03:12.240 treatment and evaluation as the state hospital. That has two 62 00:03:12.319 --> 00:03:15.759 impacts that I think everyone who's listening should be concerned about. 63 00:03:16.400 --> 00:03:20.240 The first is that if the time that someone's waiting 64 00:03:20.280 --> 00:03:23.439 to be treated and evaluated is longer than they would 65 00:03:23.439 --> 00:03:25.759 face if they were sentenced on a case. In other words, 66 00:03:25.840 --> 00:03:28.719 let's say the maximum sentence is a year and they're 67 00:03:28.719 --> 00:03:31.639 waiting over a year, the law in Colorado requires that 68 00:03:31.639 --> 00:03:34.400 they'd be released. And that's not fair to the person 69 00:03:34.400 --> 00:03:36.680 who's going to chuse. But it's also not fair to anybody 70 00:03:36.639 --> 00:03:39.719 who's been impacted or could be impacted. And the other 71 00:03:39.759 --> 00:03:41.479 piece of that is, and this is an issue in 72 00:03:41.479 --> 00:03:44.240 Boulder County and I'm going to keep pushing and fighting 73 00:03:44.280 --> 00:03:48.000 to improve this, but that backlog means our Boulder County 74 00:03:48.039 --> 00:03:51.319 jail is often full. So if you have a police 75 00:03:51.319 --> 00:03:54.199 department in Boulder County that's making unrest, there are times 76 00:03:54.240 --> 00:03:56.560 where the Boulder County Jail will not accept that person 77 00:03:56.960 --> 00:03:59.719 but booking into the jail because they're full due to 78 00:03:59.759 --> 00:04:02.759 that from the state hospital, which for example, on any 79 00:04:02.800 --> 00:04:07.159 given day is sixty people awaiting transport. So this is 80 00:04:07.199 --> 00:04:10.240 impacting those individuals who are deteriorating in seals, but having 81 00:04:10.280 --> 00:04:13.919 a downstream impact on community safety. I feel passionate about 82 00:04:13.919 --> 00:04:16.639 it as District Attorney and as candidate four and if 83 00:04:16.639 --> 00:04:18.720 I have of the honor being elected as Attorney general 84 00:04:18.759 --> 00:04:19.079 as well. 85 00:04:19.560 --> 00:04:23.519 Michael Doherty our guest, Well, well, what's the fix, Michael, 86 00:04:23.519 --> 00:04:25.600 because right now we can all see what's coming down 87 00:04:25.639 --> 00:04:28.519 the tracks, and unfortunately it's already come down the tracks 88 00:04:28.519 --> 00:04:30.399 and killed people. I also would we 96 00:04:50.759 --> 00:04:53.040 need as a state to see the state hospital improve. 97 00:04:53.120 --> 00:04:55.759 And that's not just my opinion, of my view because Dan, 98 00:04:55.839 --> 00:04:59.319 as you know, in twenty nineteen, a federal judge ordered 99 00:04:59.399 --> 00:05:03.279 annual f to be paid for every year, but the 100 00:05:03.279 --> 00:05:07.279 state hospital fails to meet national required standards. The taxpayers 101 00:05:07.279 --> 00:05:10.160 of Colorado, you're listeners, We have been paying these signs 102 00:05:10.199 --> 00:05:14.639 ever since at a mind boggling cost of ten to 103 00:05:14.680 --> 00:05:17.319 twelve million dollars per year. So we paid that more 104 00:05:17.439 --> 00:05:19.879 fifteen million dollars of taxpayer money over the last five 105 00:05:19.959 --> 00:05:23.199 years because we're not in compliance with the federal judge's order. 106 00:05:23.800 --> 00:05:26.199 So that's why we need to First of all, that 107 00:05:26.240 --> 00:05:28.800 money should be put to better use. But second of all, 108 00:05:28.839 --> 00:05:31.360 it really highlights how many people are suffering given the 109 00:05:31.360 --> 00:05:33.519 current situation, and there are a lot of people working 110 00:05:33.519 --> 00:05:35.600 on it. So not 162 00:07:58.000 --> 00:08:00.360 just in the justice system, our prison system, but people 163 00:08:00.680 --> 00:08:02.879 who are in the community who are really struggling with 164 00:08:02.920 --> 00:08:06.279 mental health disorders. And I see from the programs that 165 00:08:06.279 --> 00:08:08.800 we've built in the Boulder County justice system and the 166 00:08:08.800 --> 00:08:12.079 Boulder County Jail, which are consistently maxed out and the 167 00:08:12.439 --> 00:08:15.800 number of people how necessary those programs are.
